Terms of Service

These Terms of Service (ToS) govern the use of LeadHop’s SMS services, designed to protect LeadHop’s operations and limit liability.

1. Agreement

  • Eligibility: Users must be 18+ and authorized to enter binding contracts.
  • Scope: Applies to all LeadHop services, including API and platform access.
  • Acceptance: Use of services constitutes agreement to these terms.

2. Service Use

  • Services for lawful, consented SMS only, per TCPA and CTIA.
  • Prohibited: Spam, illegal content, or actions disrupting LeadHop’s network.
  • Users responsible for securing account credentials.

3. Payment Terms

  • Usage-based fees; invoices issued monthly.
  • Late payments accrue 1.5% interest monthly.
  • No refunds for terminated accounts due to violations.
  • LeadHop may adjust pricing with 30 days’ notice.

4. Termination

  • By LeadHop: Immediate suspension for ToS breaches, fraud, or non-payment.
  • By User: Via account settings, with no refund for unused services.
  • Post-Termination: LeadHop retains data per legal obligations; users lose access.

5. Limitation of Liability

  • LeadHop’s liability capped at fees paid in the prior 12 months.
  • No liability for indirect, consequential, or punitive damages.
  • No responsibility for user-generated content or third-party actions.

6. Indemnification

Users indemnify LeadHop against claims arising from misuse, including legal fees.

7. Governing Law

  • Governed by California law.
  • Disputes resolved exclusively in San Francisco courts.
  • LeadHop may seek injunctive relief globally to protect operations.
